Congrats To Another {HIGH} Bidder Taking Home The Westonka Bacon!

Looking forward to seeing that nice check care of the Lafayette Club to cover staff bash 2012 coming through the board minutes!  Anyone know what the low bid was???????

Westonka school board chooses architects


 The Westonka School Board on April 9 approved Wold Architects and Engineers as the firm to carry out work architectural on the three-year renovation project for the four schools in the district.

The selection was based on a recommendation from the facilities committee, which selected Wold out of a pool of four firms from seven total requests for proposals for the project.

The facilities committee held interviews at a March 20 open meeting to select finalists from the four firms. At this meeting, the committee determined to focus on two firms - Wold and ATS&R.

According to a Westonka school board document, an estimation by Kraus Anderson between the two firms showed that Wold could cost slightly more for the district. ATS&R was estimated to cost between $1,341,270.54 and $1,437,591.72, compared to Wold's estimate of $1,458,865.56.

Board members expressed their support for Wold during the board meeting, speaking before they voted 6-0 - with David Bond abstaining - to hire the firm.

Board Member Keith Foerster said that there was many positives that made Wold stick out from the rest.

"We felt there were measurable advantages working with Wold," "One of the key things that stuck in the facility committee's mind was building information modeling."

The information modeling is a model view of construction or remodeling changes made during the planning stage.

"This is something that's not typically always offered in renovation type work, but this was part of the package that Wold provided to us," said Forester.

Forester also said he also liked Wold's cost estimating service, engineering services and no additional fees for alternatives.

Bond, who abstained from voting because he worked with Wold for seven years, said that he felt the process was complete enough to hire Wold.

"I could cast a good vote on this one. I witnessed a great process, I know it was complete, and it addressed all the right questions necessary to hire this firm for Westonka," he said. "I think we're on the right track here."

Wold presented a summary before the vote of what they told the facilities committee in the interview process. Wold representatives Paul Aplikowski and Kevin Marshall were present at the meeting.

"We're a significant player in the K12 market in Minnesota," said Aplikowski. "It's about 70 percent of what we do."

According to the school board resolution, the maximum amount of Wold's contract will be $1,459,000. The price will "be based on 5.5 percent of the determined construction costs plus reimbursables."

The renovation project will begin this summer.

Our School Board Is Very Entitled

To party on the taxpayers' dime!  Don't you love watching them hold up these vendors for your tax dollars??  Better yet, spending those dollars on a big old staff party at the Lafayette Club......the Lafayette Club that is managed by the spouse of one of the board members?  I'm just a lowly taxpayer, but shouldn't I get an invite??  Anyone else think this is just plain wrong any way you look at it??

Boy, Do We Need An Independent Project Accountant!

One that has no ties to anything other than integrity!  Now that Ehlers has been hand-picked for the financial adviser contract and we are in the midst of volumes of double talk over the excessive contract about to be awarded to the construction manager, it's time focus on the most troubling numbers in the entire project.  Pay close attention to lines 415 & 417 on the original Kraus proposal at the bottom of this page.

I guess they went with percentages on these lines so the end number wouldn't look so large?  Nevertheless, a 6% inflation contingency comes to $1,369,427.  Inflation?  What inflation?  Where does this money end up and who accounts for it since inflation is negligible?

Soft cost are factored at 25% or $5,706,118.  This is where the soft costs are going:


Architectural Fees for Remodel (different than new) 5.5 to 7%
Mechanical and Electrical – 2 to 3% (pending scope)
Permits – 1%
Testing – 1%
Misc Survey – 1% (varies on area)
Bond – (in today public bid economy) 1%
Misc Owner costs (Staff and misc needs during the project can be charged to a project if district chooses) – 2%
Legal Fees – .5%
Insurances - .5% (depends on your policy in place)
Commissioning per the State of MN – 1 %
Plan Reproduction/advertising for Competitive bidding – .5%
Design Contingency – 5% (highly recommend for remodel)
Construction Contingency – 5% (highly recommend for remodel)

I still can't get my head around the fact 10% of this entire project or $2,282,427 is earmarked for Design & Construction Contingencies! I thought Kraus Anderson was the best of the best and we paid $500,000 extra to make them even better? Maybe they are; just not their estimators?

Would love to see a full accounting for the 1% or $228,242 to Ehlers?!

Would love to see a receipt for every paperclip the 2% miscellaneous owner's slush fund buys!

The good news is; should the bonds pass, you can protect your large investment by also voting for Hejna, Mailey and Notch!  We will construct a system to account for every penny of this money, be unafraid to challenge vendors for the lowest price and highest quality possible, channel every cent into its intended purpose, and provide you, the voter/taxpayer, with a full, regular public accounting every step of the way.

You too can ponder the meaning of this statement from chairman Botts at the 52:20 minute mark: "....they gave us PROFESSIONAL PLACEHOLDERS for the amount of money that we are PROBABLY going to need to remodel these old buildings.  I'm confident we have enough money to do the job right and THEN SOME SO THAT WE CAN DO A FEW MORE PROJECTS."

So many contradictions............

I'm still trying to figure out how if we have "professional placeholders,"why we have enormous soft cost buffers for over runs PLUS a 6% inflation contingency built into the 'estimate.'

It Just Keeps Getting Better......

Do they seriously believe we are buying the need for this project to have "two, full-time field superintendents," at a cost of nearly $500,000??  I wasn't aware we were re-building the World Trade Center on our school campus.

On the bid sheets I have; which are posted on this very blog, the low bidder = $494,500 and the high bidder = $997,220.  In my world, Dave, that = a difference of $502,720.  Nevertheless, the low bidder offers a Sr. Project Manager, an on-site Project Representative and a Project Assistant in their bid.  The guardians of Westonka, want to pay $500,000 more so a couple guys can sit in a construction trailer?  KA's bid sheet doesn't even show what they offer??
 
How about a spreadsheet, Dave, with an apples to apples comparison??  You do have one of those, right?  It is my understanding that information was requested from Kevin, and, well, we all know how far that got us.  Fire that spreadsheet right over, Dave, and I will post it up!  I answer all my email addresses!

Borg & Bott's Finest Hour

So they go through the dog & pony show of setting up a competitive bid scenario, yet they select the bid that is highest of any submitted by $100's of thousand's of dollars?!?!  $502,720 over the lowest bid submitted.  Who does this and why??  It's your money!!!

You don't have to like Tom Notch, but his letter is FACT!  Please read it!

Review the bids for yourselves!!  The {high} bid of $997,220 from everyone's favorite, Kraus-Anderson, was selected!!


However, we had this choice at $776,374:

$502,720....that's a half mill!!  No wonder these guys are worried enough about the possibility of me commissioning an audit they need to resort to libel!

Wow! These Burnsville Taxpayers Are Really Upset!

And their board and superintendent have only wasted a fraction of the money that Mr. Borg & Mr. Botts have!

You can tell them....and tell them....and tell them....even do the research and spreadsheets for them--because they can't or won't--but no one is going to tell Kevin, Dave and apparently their brothers in arms on the Burnsville staff that the sun rises in the east!

 "Even before Tania Chance was given a new two-year contract, some people were wary about the move, which ultimately cost the Burnsville school district about $255,000.

"I questioned it," said Libby Duethman, president of the Burnsville teachers union. "We experienced some [difficulty] in our first year working with her and ... some concerns. I asked why they had to offer her a two-year contract."

The school board was under no obligation to give its human resources director a contract, as she is not a licensed employee and under state law is not required to have one.

Nevertheless, the school board voted 6-1 last summer to grant the contract. Six months later, the two sides agreed to a $254,814 buyout in one of the largest separation agreements on record for a school administrator in the state."

Amazing!

They still can't be honest and disclose the "fixed cost" that Ehlers was paid or admit, in a fixed cost to perform environment, leveraging multiple companies against each other would have resulted in a lower fixed cost to the school district!

Before Sutter present the series 2012B bond, which was also up for vote that night, Board Member David Bond asked him to clarify on whether Ehlers was making any money on the sale of the bond.

"Our only compensation on bond sales is the fee we charge to the district," said Sutter. "The underwriter makes money on selling the bonds, and we don't know exactly what that will be because it depends on what they actually sell the bonds. But that is part of the competitive bidding process."

Gee Joel, how about an estimate??

There NEVER Was An Audit

Letter writer defends district's financial advisor decision

To the Editor:

The letters written by Tom Notch and Nick Stoiaken in the 1/21/12 issue of the Laker are inaccurate and require corrections.

Bond prices are set by market demand - not board members or their financial services providers. To claim the school is paying an extra $2,000,000 is absurd, since nobody as of this day knows the market price. The bonds will be sold competitively, and we predict better than projected interest rates, which will bring a savings to the taxpayers.

Our process in selecting our financial advisor is consistent with our policy. In 2009, the district interviewed and the School Board Finance Committee approved the district's financial advisor. Action regarding the sale of bonds is done publicly and most recently was discussed at a publicly televised meeting on Jan. 9, 2012.

It's no small coincidence that Notch's running mate, Don Mailey, has gone as far as to request the Office of the State Auditor to audit our selection of our financial advisor. It's his right, but these things cost time and money.


[Don Mailey] Completely false! First, you can't just request this audit, it must be petitioned for. In a district the size of Westonka, this petition would require nearly 500 signatures. This information is readily availible on the Auditor's website, so it doesn't make a lot of sense for Mr. Botts to fabricate about me by claiming I simply picked up the phone and ordered an audit of the district. Maybe research isn't his thing. Second, send me the bill for this "audit." Third, what "selection?"

There is good news in the matter as they examined the situation and reported: "the district engaged in a periodic review of its financial services advisor, as recommended by this Office."

[Don Mailey] Define examination, Dave? I thought it was a "full audit?" A periodic review--in 2009--is not the same as pricing a $42,000,000 project in 2012, that was funded 3 months ago. What days were the auditors at Sunnyfield "examining" the district's "periodic review?"


The issue is not that these people have differing opinions; the issue is they are not being constructive. Our schools have made tremendous progress, which our staff is committed to grow upon. Communication tactics such as these only divert time and resources from this goal.


[Don Mailey] This issue has nothing to do with the teaching staff which is doing an excellent job at Westonka. It is centered on the stubborness of an administration who would rather waste money than admit they are wrong!

More Than a Number

The numbers in the chart below are from Ehler's index of choice; the 20-Bond Go Index as submitted by the publication, The Bond Buyer.  Please consider:

8/11/2011 - Ehlers delivers an estimate of $41,765,598 while the 20-BGI is at 3.97%.

12/15/2011 - Northland delievers an estimate of $39,959,985 while the 20-BGI was at 3.92%.

{ ^ }  So much for a huge drop in rates being the reason for the difference in these two estimates.

1/14/2012 - Ehlers claims in The Laker, their estimate is now millions less due a projected rate of [two] 2.75%.  The 20-BGI was quoted at [three] 3.62% on 1/12/2012.

{ ^ }  This is very curious since The Bond Buyer indicates its index hasn't broken below [three] 3.00% since 1962.

One thing that is certain, is the index reached its lowest level since 1967, on1/19/2012, at 3.60%.  Since that time, the index has increased to 3.68%.  Timing is everything in this venue and rates generally rise into the spring.  Seems like a waste of time and money that the district wasn't locked and loaded and ready to roll like so many other districts were two weeks ago.

13 Attempts & I Can't Get An Honest Answer To Why Ehlers Is Not Being Forced To Compete

“The errors led Murley to call for an outside audit. The report, by Synesi Associates, was released last week and was critical of the district’s financial operations.
Among the concerns cited in the report were budgets that were developed without the input of educational leadership, not seeking competitive bids for services and no standard operating procedures for purchasing. Synesi recommended the district hire a budget director.”

2. Sale. The District has retained Ehlers & Associates, Inc. (Ehlers) in Roseville, Minnesota, as
its independent financial advisor for the Bonds. Ehlers is authorized to solicit proposals in accordance
with Minnesota Statutes, Section 475.60, Subdivision 2(9). If the issuance of the Bonds is approved, the
School Board shall meet at the time and place specified in the Official Statement to receive and consider
proposals for the purchase of the Bonds.

3. Official Statement; Negotiation of Sale. Ehlers is authorized to prepare and distribute an
Official Statement and to open, read and tabulate the proposals for presentation to the Board.

This is despite knowing what the MN Auditor’s position is on this behavior?  You are leaving the community with little choice but to petition the state for an audit to unveil what is driving this behavior.  Of course; as you know, the district will bear the entire cost of this process:

So you missed/skipped paragraph 2, page 13:

He also said he is very pleased the auditor's office recommended that the district adopt a formal bidding process.

"I hope going forward the board will implement the recommendations made by the state auditor's office as a first step toward being more transparent and fiscally responsible toward the taxpayers who fund these schools," he said.



And:

3. The lack of a transparent process for requesting proposals or other "bidding" processes regarding the underwriting of bonds.

Petitioners were
shocked to learn that the School Board didn't have a competitive bidding process in place when it awarded $37 million (principal and interest) in bonds to Northland Securities in a negotiated sale. The auditor said this: "The formal process of bidding serves several public objectives. Certainly one objective is to obtain the lowest price, but another important goal of bidding is the opportunity it allows qualified entities to obtain public business in an open process." It's common sense to obtain more than one bid when making a major purchase - especially when millions of dollars are involved. Could the School Board have negotiated a more favorable rate if they had opened up the bidding process? We'll never know, and that's inexcusable. A policy without a bidding process exists and that has to change.




Just so we have it on record for all to see, Mr. Borg, you are saying you disagree with every aspect of point 3, immediately above?  This is the type of district you are running?

I don’t care what practices and procedures you feel you have followed/adhered to in the past!  The community wants the best price and terms possible in the upcoming debt sale and that is not possible via your monopoly with Ehlers.  Is it really that hard for you to comprehend this or do you really not care about wasting money??

Attached is the report from the Office of the State Auditor(OSA) that you made reference to. On page 8 and 9 they address the topic of bidding out of professional services.   In this section, they recommend that district's "periodically review" who they use for professional services.  Westonka did this review in August of 2009.  We feel that our practices are within the recommended guidelines.  Ehler's has been involved(answering questions and providing tax impact scenarios) with this bond project since fall of 2010.  Again, the School Board Finance Committee determined that we should use Ehler's (one of three firms that were evaluated in 2009).

Why are we any different than St Anthony?
 
The Auditor's office also recommended that the District also adopt a formal bidding process. No bidding process was used for the underwriting of $22,000,000 in bonds awarded to Michael Hoheisel of Northland Securities in 2008. Principal and interest will amount to a debt of $37,000,000 to district taxpayers, yet there were no competitive bids for such a large expenditure, and that is unacceptable!

We know how they [Ehlers] were picked in the past.  You are straying from the topic.  The question is, was, and will remain; ‘why won’t you seek the most competitive pricing in the market for the district’s upcoming $30,000,000 bond issue??’
 
No one cares what happened 2.5 years ago.  Either you have decided—2.5 years ago—Ehlers is the district’s designated financial advisor and you have a policy in place governing this decision, or, you will now pursue an open bidding process which best serves the district and its taxpayers by soliciting the lowest cost/highest quality vendor for this future bond placement.
 
Civil?  It is an interesting point of view that communication must be hidden behind closed doors to be “civil?”  Perhaps you feel my questioning of why you are not pursuing the best financial outcomes for the district and its taxpayers is somehow “uncivil?”  I will stick with copied communication that can be shared with the many stakeholders out there who have the same question I do, namely, ‘why is this future, large-scale, financial transaction being monopolized for Ehlers?’  Until you can clearly state why you refuse to seek an open and competitive solution to this piece of public business, peripheral questions are going to continue.

In talking to Gary Hejna, our Treasurer, he also would not advise the district to interview again at this time.  [Don Mailey] Gary Hejna?  Who is running the school district?  You, or Gary Hejna?  Wait, isn’t Gary Hejna soon to be our ex-Treasurer, after you spent all that time, money and resources defeating him in the recent election?  After that, you defer to his expertise?  Tell me, why didn’t you defer to his expertise when he advised you against OPEB??
 
Why are you so against the potential savings that forcing Ehlers to compete for a $30,000,000 float may save the district?  Why??  Someone really needs to get to the bottom of your biased protectionism of this firm at the expense of the district’s taxpayers!  I-Team, are you out there?!

I would recommend that you talk to Gary Hejna(he was part of the finance committee in 2009, you ran with him for school board this year, and he is our current treasurer).  
 
In 2009, the process of the review of firms was discussed with our board, our finance director and myself conducted the interviews, and the finance committee approved the recommendation.  I have spoken with Gary Hejna and he agrees with the decision and my recap of this process.  The school board does not have a policy for specific companies, firms, or advisors that we work with.
 
The board in 2009 included Tom Notch, Keith Foerster, Dave Botts, Ann Bremer, Martine Hewitt, Ron Faust, and Gary Hejna.

Who were the members of the finance committee that interviewed these firms 2.5 years ago?  Are they all still on the board?  Since I don’t live in a vacuum, I would be interested in asking them their opinions in 2011.
 
If their/your conviction to exclusively use Ehlers is this firm, surely a policy was created?  Please email me this policy at your convenience.
 
I look forward to receiving the names of the finance committee members who conducted these interviews in early 2009!

The district interviewed firms about 2 and 1/2 years ago.  One the firms that we interviewed was Northland Securities.  After the interviews, the Finance Committee approved to stay with Ehlers.
 
We will continue to monitor companies that we use for competitive service and pricing.
